First Offense

- Jail sentence of up to 48 hours or attendance at victim impact panel
- Attendance at alcohol safety program
- Minimum 90-day license suspension, but may be reduced for hardship in certain cases
- Hardship reduction not available if you refused to submit to chemical test
Second offense
- $600-$1500 fine
- Jail sentence of five days to a year
- Community service of 10 days to a year
- License suspension of up to two years; may be eligible for reinstatement after one year
- Must go through alcohol/drug assessment, and may be required to go to rehab
- Vehicle may be seized and forfeited
Third offense
- $2000-$5000 fine
- Jail sentence of one year to five years
- License suspension for five years; may be eligible for reinstatement after three years
