  • Attendance at alcohol safety program
  • Minimum 90-day license suspension, but may be reduced for hardship in certain cases
  • Hardship reduction not available if you refused to submit to chemical test

Second offense

  • $600-$1500 fine
  • Jail sentence of five days to a year
  • Community service of 10 days to a year
  • License suspension of up to two years; may be eligible for reinstatement after one year
  • Must go through alcohol/drug assessment, and may be required to go to rehab
  • Vehicle may be seized and forfeited

Third offense

  • $2000-$5000 fine
  • Jail sentence of one year to five years
  • License suspension for five years; may be eligible for reinstatement after three years
